Model Hiring Terms and Conditions

The following list all terms and conditions which aid the photographer (“The Company”) in selecting which model (“The Signee”) will be hired for projects.

If any of the following do not align with the model’s standards/conditions, please seek other photographers to help with your modeling needs.

The following terms and conditions are non-negotiable

Released Images / Rights to Images:

  • As a hired project, "The Company" holds all rights to images and holds no obligation to release any images, now or in the future. due to agreed monetary compensation for the "The Signee's" labor.

  • After agreed compensation is established, the payable amount provided to "THE SIGNEE" will be full compensation for their time and effort.

  • Should “The Company” release any images to the model, it will be at their discretion.

  • "The Signee" will be GRANTED the rights to share/repost released images on any of their internet based platform, so long as it is for portfolio use (none-monetary gain)., this incudes event promotion. Any portrait/image/creation shared/displayed/mentioned must have credits reflected for "The Company".

  • "The Signee" WILL NOT BE GRANTED the rights of submitting any portraits for any publication, use of images for monetary gain. Marketing/digital flyers are extremely prohibited unless purchased from "The Company". Released images can ONLY be used for portfolio building purposes.

  • If “The Signee” would like to purchase images for their portfolio, monetary gain, promotional event, or digital flyers, complete the “Photo Request Booking” process.

  • In the future, should “The SIgnee” request to have released images archived (removed completely and never to be used again by “The Company”), an e-mail must be sent to “The Company”.

Wardrobe Terms:

  • Wardrobe will be provided primarily by “The Company”.

  • Once concept and wardrobe has been established, “The Signee” is encourage to bring any other props are wardrobe pieces to help enhance the concept.

  • All wardrobe pieces must be returned to “The Company”, at the end of the photoshoot. This helps to reduce “The Company’s” wardrobe pieces being used for other photoshoot projects and preserves the uniqueness of “The Company’s” original creativity.

Cancellations / Late Arrivals:

  • If the photoshoot is canceled, for any reason on "The Company's" behalf, "The Signee" will receive full monetary compensation amount. (i.e. if deposit has been paid to "The Signee" only remaining compensation amount is owed by "The Company"). This includes failure of electronic equipment (see limitation of liability below).

  • If the appointment is canceled, for reasons on "The Signee's" behalf, "The Signee" must return any deposit/monies paid by "The Company" in addition to 50% of total studio/location fees already paid by the company using the same method in which it was received (i.e. PayPal, Venmo, Zelle, Cashapp, etc.) within 48 hours.

Reasons for cancellation, on "THE SIGNEE's" behalf are, but not limited to:

  • "The Signee" canceling the schedule appointment for any reason, after the arrangement has been officially scheduled.

  • "The Signee" arriving on location 15 minutes (or more) later than the agreed photoshoot time.

  • "The Signee's" wardrobe is wrinkled/torn or not "photoshoot ready" at the time of schedule appointment.

  • "The Signee" is intoxicated or not rested for scheduled appointment.

  • “The Signee” disagrees with the “The Company’s” artistic interpretation (see limitation of liability below).

  • “The Signee’s” chaperones disrupting the flow of the photoshoot or distracting “The Signee” during hired time.

Limitation of Liability:

  • "The Signee" understands that photographic equipment (including lights, cameras, digital calibrators, etc.) are electronic devices and any unforeseen failures may occur, without negligence on behalf of the photographer.

  • In the event that all or some of the photographs fail to materialize or there is photographic failure due to reasons beyond the "The Company" control, neither party shall be liable for indirect or consequential losses.

  • "The Signee" understands the concept design and photoshoot is solely based the photographer's creativity. Any disagreements over artistic interpretation will revoke “The Signee’s” entitled compensation, this includes return of any deposit/monies “The Signee” has received from “The Client”.

  • It is therefore agreed that “The Signee” forever holds harmless "The Company" for any perceived damages resulting from the artistic interpretation of the images taken to the extent allowed by law excepting.

  • I release and discharge "The Company" from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also insure to the benefit of the heirs, legal representatives, licensees, and assigns of "The Company", as well as the person(s) for whom he took the photographs.
